These Terms of Service ("Terms") govern your use of qinary.com and any software application, tool, or service that Qinary Corporation ("Qinary," "we," "us") makes available to you (together, the "Services"). By using the Services you agree to these Terms. If you do not agree, do not use the Services. This document also serves as the end user license agreement (EULA) for Qinary's software applications.
Qinary provides brand strategy, marketing, and related business services, along with software that supports our internal operations and client work. Some of our applications connect, at your direction and with your authorization, to third-party platforms such as accounting, payment, and marketing systems. When you authorize such a connection, you permit our software to access data from that platform on your behalf, solely to provide the functionality you have requested.
Subject to these Terms, Qinary grants you a limited, non-exclusive, non-transferable, revocable license to use our software for its intended business purpose. You may not copy, resell, sublicense, reverse engineer, or attempt to derive the source of our software except to the extent that restriction is prohibited by law. Qinary retains all right, title, and interest in the Services, including all related intellectual property.
When you connect a third-party platform (for example, QuickBooks Online through Intuit), your use of that platform remains governed by that provider's own terms and privacy policy. Qinary is not responsible for the availability, accuracy, or practices of third-party platforms. You can revoke any connection at any time through that provider's settings or by contacting us, and we will stop accessing the connected data going forward.
Our handling of data is described in our Privacy Policy. Data we access through an authorized connection is used only to provide the requested functionality, is not sold, and is protected using reasonable security measures. You may ask us to disconnect a platform or delete data we hold on your behalf by contacting us.
Where the Services are provided under a separate written agreement or order (for example, a statement of work or subscription), the pricing and payment terms in that agreement apply. Nothing on this site is an offer to provide services free of any applicable fees agreed elsewhere.
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error free, or that any data output is complete or accurate for your specific purpose. Our software is a business tool and is not a substitute for professional accounting, tax, legal, or financial advice.
To the fullest extent permitted by law, Qinary will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to Qinary for the Services giving rise to the claim in the twelve months before the claim arose.
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if we discontinue a Service. On termination, the license granted to you ends and you must stop using the affected software.
We may update these Terms from time to time. When we do, we will revise the date above. Continued use of the Services after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona.
